This Privacy Policy (“Policy”) describes how ShowUs, Inc., our affiliates, and subsidiaries (collectively “we”, “our”, or “us”) collect, use, and share your Personal Information when you visit or interact with us through our website https://showus.tv (the “Site”), interactive shows, video podcasts, AMA events, pre-, live game or post-game hangouts, or other live events (“Events”), create or use an account, or use any other sites, pages, features, services, or applications to which this Policy applies (collectively our “Platform”). This Policy should be read together with our Terms of Use, which govern your access to and use of the Platform, including account registration, Platform availability, User Content, Creator Content, and sponsor program terms.

1. Personal Information We Collect

We collect information that identifies, describes, or is reasonably capable of being associated with you (“Personal Information”). Personal Information does not include publicly available information as defined by applicable law, or any data that has been deidentified, aggregated, or otherwise anonymized to the fullest extent permitted by law.

1.1 If You Visit the Site or Platform

When you visit our Site, we collect the following Personal Information from you:

Personal identifiers, such as your IP address and other online identifiers.
Internet and network activity, such as the browser you used, your browsing and search history, and your interaction with the features of our Platform, which is described in more detail below in Section 4 on Cookies.

1.2 If You Sign Up for an Account

When you sign up, register for, or create an account with ShowUs, Inc., we collect the following Personal Information from you:

Personal identifiers, such as your name, phone number, email, and address.
Account information, such as your username, password, password hints, age or eligibility information, parental or legal guardian consent status where required, profile settings, account preferences, and other data we may reasonably request to set up, verify, secure, support, or manage your account.
Visual information, such as your profile picture.
Inferences and preferences, such as which content, Events, creators, Platform features, or sponsor opportunities may interest you.

1.3 If You Purchase Access to an Event or Sign Up for a Self-Serve Creator Plan

When you purchase access to an Event or sign up for a self-serve creator plan, including where an eligible minor participates with any required parent or legal guardian consent and supervision, we collect the following Personal Information from you:

Personal identifiers, such as your name, phone number, email, and address.
Account information, such as your username and, where applicable, age or eligibility information and parental or legal guardian consent status.
Commercial information, such as information about your order, including specifics about which Event you purchased, self-serve creator plan or similar commercial program you selected, and any related features.
Financial information, such as your payment method, billing information, tax or payout information where needed for creator or commercial programs, and limited payment details needed to process or confirm your transaction. Payment processing is handled by our third-party payment processor, and we do not directly store your full payment card number.
Platform usage, technical, operational, and diagnostic information, such as login activity, feature usage, device and browser information, error logs, security events, support requests, availability or performance data, and information needed to operate, maintain, troubleshoot, secure, modify, suspend, or discontinue Platform features in accordance with the Terms of Use.
Creator sponsor and commercial-program information, such as account and profile information, Creator Content or other submitted materials, audience or performance analytics, contact information, payment, payout, and tax information, sponsor or brand preferences, and any existing sponsor restrictions, category conflicts, exclusivity commitments, eligibility limits, or similar constraints you choose to provide so that we can present, evaluate, administer, monetize, report on, and support sponsor, brand, revenue-share, or similar opportunities and programs.

1.4 If You Watch, Attend, or Participate in an Event

When you attend or participate in an Event, including as a ticketed fan participant and including when you ask a question, make a comment, or write a message in the chat box, we collect the following Personal Information from you:

Account information, such as your username.
Internet and network activity, such as the browser you used, your browsing and search history, device and connection information, log data, and your interaction with the features of our Platform, which is described in more detail below in Section 4 on Cookies.
User generated content, such as chats, comments, questions, profile information, Creator Content, or other messages, materials, or content that you may post, submit, upload, send, or communicate through the Platform or application where the Event is streamed. Public, profile, user-generated, Creator Content, and other submitted materials may be used as described in the Terms of Use; Personal Information included in those materials is handled as described in this Policy.
Audio and video recordings that we may take of the Event and retain, replay, distribute, monetize, or otherwise use on the Platform, our social media channels, or other applications as described in the Terms of Use and this Policy. By participating in an Event, you consent to such recording and its use as described in the Terms of Use and this Policy, and if you are under 18, your parent or legal guardian must provide any consent and supervision required by the Terms and applicable law.
Inferences and preferences, such as other Events or content that may interest you.

1.5 If You Interact with Us on Social Media

You may interact with us on social media (e.g., Twitch, TikTok, or YouTube) if you view or stream Events on one of our channels; follow or subscribe to one of our channels; or, link or sign in with your social media account. If you do, we may collect the following Personal Information from you and through that social media channel depending on the features of that social media channel and what setting you may have enabled:

Personal identifiers, such as your name, phone number, email, and address.
Your social media account information, such as your profile name, URL, friends, followers, likes, interests, posted messages, and other content.
Education information, such as your education history, if applicable and you have shared this information with us.
Professional or employment-related information, such as your work history, if applicable and you have shared this information with us.
Characteristics, such as your birth date, age, gender, or marital status, if applicable and you have shared this information with us.

Your use of social media is subject to each social media channel’s privacy policy and terms, which may be different from ours. Please read those policies carefully to understand how they treat your Personal Information, what rights you may have, and who to contact for questions. We have no control over these social media channels and we are not responsible for their practices.

1.6 If You Follow Us or Subscribe to Updates

You may choose to follow us or sign up to receive schedules, newsletters, or other updates about our Platform. If you do, we may collect the following Personal Information directly from you:

Personal identifiers, such as your name, phone number, email, or address.
Account information, if you have an account with us, we may collect your username.
Commercial information, such as what you signed up to receive information about.

1.7 If You Contact Us

When you contact us through email, telephone, direct message, or any other way, we may collect the following Personal Information from you:

Personal identifiers, such as your name and the contact information you provide (e.g., your phone number or email).
Account information, if you have an account with us, we may collect your username or other account information related to the reason you contacted us.
Commercial information, if you contact us in relation to an Event, we collect information about that Event.
Audio information, if you call us your call may be recorded. You will be notified at the start of the call, and by continuing you consent to the recording.
Social media information, if you contact us via social media, then we may collect information related to your social media account as described in Section 1.5 above.

2. How We Use Personal Information

We use the Personal Information we collect for the following business and commercial purposes. We retain your Personal Information for as long as reasonably necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, resolve disputes, and enforce our agreements, or until you request its deletion:

Operating our Platform and Providing You with Services. We use your Personal Information to operate, maintain, provide, create, secure, support, troubleshoot, modify, and develop all of the features and functionalities found on our Platform. Additionally, we use your Personal Information to manage and maintain your account (both for ticketed fan participants and creator plans), confirm eligibility and any required parent or legal guardian consent for under-18 users, enforce our account security measures, fulfill your purchases and orders, process your payment, provide customer support, monitor Platform usage and performance, address technical or operational issues, and administer suspensions, restrictions, modifications, or discontinuation of Platform features as described in the Terms of Use.
Communicating with You. We use your Personal Information to communicate with you and, where applicable, your parent or legal guardian about our Platform, your account, Platform availability or feature changes, sponsor or brand opportunities for which you may be eligible, to provide you a receipt or order confirmation, to deliver order updates, and if you contact us with a question or concern. Additionally, we use your Personal Information to deliver news, updates, and other types of communications according to your subscriptions, alerts, and other preferences.
Evaluating and Improving our Platform. We may analyze your Personal Information for quality assurance, analytics, debugging, testing, training, safety, security, and troubleshooting purposes, to help us understand how users and Creators interact with the Platform, and to improve, customize, maintain, and support our Platform.
Advertising, Sponsorships, and Commercial Programs. We use your Personal Information we collect for some advertising, sponsorship, brand partnership, analytics, and monetization purposes. We may also use the insights we gain about how you use our Platform to evaluate and improve our ability to attract new users, present and evaluate Creator sponsor opportunities, administer revenue-share or similar commercial programs, measure performance, report results to sponsors and brand partners, and support the commercial uses of public, profile, user-generated, and Creator-submitted materials described in the Terms of Use.

2.1 Legal Bases for Processing (EEA and UK Residents)

If you are located in the European Economic Area (“EEA”) or the United Kingdom, we process your Personal Information on the following legal bases under the General Data Protection Regulation (“GDPR”) and the UK GDPR:

Consent. We rely on your consent when you participate in Events and consent to audio and video recording, subscribe to newsletters or updates, accept non-essential Cookies on our Site, or provide optional information through social media interactions. For users under 18, we rely on parent or legal guardian consent where required by the Terms or applicable law, including verifiable parental consent for children under 13 where legally required. You have the right to withdraw your consent at any time by contacting us at [email protected]. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.
Performance of a Contract. We rely on performance of a contract when you create an account with ShowUs, Inc., purchase access to an Event, sign up for a self-serve creator plan or sponsor, revenue-share, or similar commercial program, or use features and functionalities of our Platform that require an account.
Legitimate Interests. We rely on our legitimate interests, or those of third parties, when we operate, maintain, support, troubleshoot, secure, and improve our Platform; analyze usage patterns, Platform performance, and feature engagement; detect and prevent fraud, security incidents, and illegal activity; enforce our Terms of Use and protect our legal rights; evaluate, present, administer, monetize, report on, and support sponsor, brand, Creator, revenue-share, and similar commercial opportunities; and share information with affiliates and business partners for purposes consistent with this Policy. We have balanced these interests against your rights and freedoms and have implemented appropriate safeguards. You have the right to object to processing based on legitimate interests as described in Section 6.5 below.
Legal Obligation. We rely on legal obligation when we process your Personal Information to comply with applicable legal and regulatory requirements, including responding to lawful requests from law enforcement and regulatory authorities.

2.2 How Long We Retain Your Personal Information

We retain different categories of Personal Information for the periods described below. Where a period is stated, it runs from the date the Personal Information was collected unless otherwise noted.

Account Information. We retain your account information, including your name, email address, username, password, age or eligibility information, and parent or legal guardian consent records where applicable, for as long as your account remains active and thereafter only as reasonably necessary to comply with our legal obligations, resolve disputes, enforce our agreements, maintain security, and administer account closure or deletion requests.
Purchase and Transaction Data. We retain purchase records, order details, and payment information for as long as reasonably necessary to comply with tax, accounting, chargeback, fraud-prevention, and financial reporting obligations.
Event Recordings, User Generated Content, and Creator Content. We retain audio and video recordings of Events, user generated content, and Creator Content, including chats, comments, messages, profile materials, and submitted content, for the period reasonably necessary to provide the Platform, maintain Platform content, administer sponsor, brand, revenue-share, or similar commercial programs, comply with applicable legal obligations, resolve disputes, enforce our agreements, and honor deletion or minor-content removal requests where required by applicable law.
Communication Data. We retain your communication history until you unsubscribe or request deletion, whichever occurs first.
Analytics and Usage Data. We may retain aggregated or anonymized analytics data for research, Platform improvement, performance measurement, sponsor and brand reporting, and other lawful business purposes where it no longer identifies you. We retain identifiable analytics data, including IP addresses, browsing history, feature engagement, and performance or diagnostic data, only for as long as reasonably necessary for the purposes described in this Policy, including security, analytics, troubleshooting, sponsor and commercial program administration, and legal compliance.
Social Media Interaction Data. We retain social media account information and interaction data for as long as reasonably necessary to respond to or manage your interaction with us, administer our social media channels, comply with applicable law, and protect our rights.
Security and Fraud Prevention Data. We retain information relating to security incidents, fraud prevention, and legal claims for as long as reasonably necessary to investigate, prevent, or respond to the incident or claim, comply with applicable law, and protect our rights.

If you request deletion of your Personal Information under Section 6.3, we will delete or anonymize your information within 45 days unless we are required or permitted to retain it under applicable law.

We may share your Personal Information with third parties under the following circumstances or as otherwise described in this Policy. Additionally, we may disclose your Personal Information as described in Section 8 (Legal Disclaimer) below, including to comply with legal obligations, respond to law enforcement requests, or protect our rights:

With Service Providers. We may share your Personal Information with service providers who perform services on our behalf, such as payment processing, payout and tax administration, shipping and order fulfillment services, hosting services, analytics, advertising technology, communications, security, troubleshooting, or customer services and support. These service providers may access your information and are required to use it solely as we direct to provide our requested service.
With Affiliates. We may share your Personal Information with our affiliates (meaning entities controlled by, controlling, or under common control with ShowUs, Inc.) for purposes consistent with this Policy, including to provide and improve our Platform.
With Business Partners. We may share Personal Information with business partners, including sponsors, advertisers, brand partners, distribution partners, analytics providers, and similar commercial partners, where reasonably necessary to make Platform content or features available, evaluate or present opportunities, monetize content or programs, measure engagement or performance, or report on campaigns, subject to your choices and applicable law.
With Sponsors and Brand Partners (Creator Sponsor and Commercial Programs). If you are a Creator, Personality, or other user who participates in or may be considered for a sponsor, brand, revenue-share, or similar commercial program described in or governed by our Terms of Use or other applicable terms, we may share your account, profile, content, performance, analytics, contact, payment, tax, sponsor-preference, conflict, eligibility, and similar information with ShowUs Sponsors, sponsors, advertisers, brand partners, agencies, analytics providers, service providers, payment processors, and professional advisors as reasonably necessary to present, evaluate, administer, monetize, report on, and support those opportunities and programs. You may provide information about existing sponsor restrictions, category conflicts, exclusivity commitments, eligibility limits, or similar constraints, and we may use and share that information as reasonably necessary to evaluate potential opportunities and avoid or manage conflicts.
With Your Permission. With your consent or at your request, we may share your Personal Information with third parties outside the scope of this Policy. If you are under 18, we may require consent or authorization from your parent or legal guardian where required by the Terms or applicable law. The Terms of Use and any applicable Additional Terms govern licenses, permissions, compensation, revenue-share terms, and other commercial rights in User Content, Creator Content, or sponsor-program participation; this Policy explains how we handle Personal Information associated with those activities.

3.1 Service Provider Obligations and Data Processing Agreements

When we share your Personal Information with service providers, we use contracts designed to require such service providers to:

Limit the service provider’s use of your Personal Information to the specific services performed on our behalf;
Prohibit the service provider from selling, retaining, using, or disclosing your Personal Information for any purpose other than performing those services or as otherwise permitted by applicable law;
Require the service provider to implement and maintain reasonable security measures to protect your Personal Information;
Require the service provider to notify us of any data breach or unauthorized access to your Personal Information;
Grant us the right to audit the service provider’s compliance with its contractual obligations; and
Require the service provider to delete or return your Personal Information at the end of the service relationship, unless retention is required by law.

For service providers that process Personal Information of EEA or UK residents, we enter into data processing agreements designed to require the service provider to: (i) process Personal Information only on our documented instructions; (ii) ensure the confidentiality of its personnel; (iii) implement appropriate technical and organizational security measures; (iv) engage sub-processors only as permitted by the agreement; (v) assist us in responding to data subject rights requests; and (vi) delete or return Personal Information at the end of the processing relationship, unless retention is required by law. Where a restricted international transfer occurs, we use Standard Contractual Clauses or another approved transfer mechanism as described in Section 10.

4. Cookies

Our Site uses cookies, pixels, and similar tracking technologies (“Cookies”) to provide, customize, evaluate, improve, secure, maintain, troubleshoot, and measure our Platform and related advertising, sponsorship, analytics, and commercial programs. A Cookie is a small piece of data or text file stored on the local hard disk of your computer or mobile device. These include our own first-party Cookies and third-party Cookies.

4.1 How We Use Cookies

We use Cookies for the following purposes:

Site Functionality. These Cookies help us run our Site securely and enable basic functions like page navigation.
Performance and Analytics. These Cookies help us analyze how you interact with our Site and Platform. These Cookies also enable us to monitor, troubleshoot, measure, and improve our Site performance, our Platform, and your experience, and to generate aggregated or other analytics for sponsor, brand, and commercial-program reporting where permitted by law.
Advertisements. These Cookies allow us to deliver advertisements that are meaningful to you. Our third-party advertising partners may use Cookies to build a profile of your interests, deliver relevant advertising on other websites, and measure the efficiency of the advertisements. The use of third-party advertising Cookies may constitute “sharing” of your Personal Information under California law. We do not knowingly sell or share the Personal Information of users under 16, or process minors’ Personal Information for targeted advertising, unless permitted by applicable law and any required consent has been obtained. Without them, services you have requested, such as account login or Event access, cannot be provided. Strictly Necessary Cookies do not require your consent. Performance and Analytics Cookies. These Cookies collect information about how you use our Site, such as which pages you visit, how long you stay on each page, and whether you experience errors. These Cookies may be provided by our internal analytics systems or third-party analytics providers.

4.5 Additional Opt-Out Tools and Global Privacy Control

You may opt out of third-party advertising Cookies using the following industry tools: the Digital Advertising Alliance at https://www.aboutads.info/choices, the Network Advertising Initiative at https://www.networkadvertising.org/choices, and, for users in the EEA, the European Interactive Digital Advertising Alliance at https://www.youronlinechoices.com.

Where required by applicable law, we recognize Global Privacy Control (“GPC”) signals transmitted by your browser or a browser extension as a request to opt out of the sale or sharing of Personal Information associated with that browser.

On mobile devices, you can manage advertising preferences through your device settings. Because device settings may change, please consult your device manufacturer’s current instructions for limiting ad tracking or resetting your advertising identifier.

4.6 Third-Party Cookies

Our Site may include Cookies placed by third-party service providers and advertising partners. We do not control these Cookies, and their use is governed by the third party’s own privacy policy. We encourage you to review those policies. Third-party services we use may include analytics, advertising, sponsorship, brand measurement, video, hosting, payment, security, customer support, and communications providers, depending on how you interact with the Platform.

5. Information Regarding Children

Our Platform is intended for individuals who are at least 18 years of age, unless a parent or legal guardian has provided any consent and supervision required by the Terms of Use and applicable law. We do not knowingly collect Personal Information from children under 13 without verifiable parental consent where legally required. If we become aware that we have collected information from a child under 13 years old without such consent, we will delete such information from our records. If you are a parent or legal guardian and believe your child under 13 has given us information and you did not provide consent, please contact us at [email protected].

5.1 Parental Rights Under COPPA

If we become aware that we have collected Personal Information from a child under 13 years of age without verifiable parental consent where legally required, we will take steps to delete that information from our records as soon as reasonably practicable. If you are a parent or legal guardian and believe your child under 13 has provided us with Personal Information without your consent, please contact us at [email protected]. You have the right to review the Personal Information collected from your child, to request its deletion, and to refuse to permit any further collection or use of your child’s Personal Information where required by applicable law.

5.2 California Residents Under 18

If you are a California resident under 18 years of age, you have the right to request removal of content or information that you have publicly posted on our Platform. To request removal, contact us at [email protected] with a description of the content and where it appeared. We will make reasonable efforts to remove the content from public view. Removal does not ensure complete or comprehensive deletion, and we may retain copies as required by law or for legitimate business purposes, including where the content has been reposted by other users or is retained in backup systems.

5.3 Children’s Personal Information Under State Privacy Laws

Several U.S. state privacy laws classify the Personal Information of children as sensitive data requiring heightened protection and consent. If we have actual knowledge that we are processing the Personal Information of a child under the applicable age threshold, we will obtain verifiable parental or guardian consent before processing that information, limit its use and disclosure to purposes reasonably necessary to provide the services requested and other limited permitted purposes, and apply additional safeguards appropriate to the sensitivity of the information.

5.4 Age Verification

We rely on users to provide truthful information during account registration and do not currently operate an independent age verification mechanism. If you are under 18 years of age and do not have any consent or supervision required by the Terms of Use and applicable law, or if you are under 13 years of age and we have not obtained verifiable parental consent where legally required, please do not use our Platform or provide any Personal Information to us.

6. Your Rights

6.1 Review or Correct Your Information

If you have an account with us, you can access, update, correct, or modify certain Personal Information at any time by logging into your account.

6.2 Unsubscribe From Certain Communications

We may contact you via email with important information about your account and other communications you have subscribed to receive. You can opt out or unsubscribe from optional communications by clicking the “unsubscribe” link at the bottom of any email, or contacting us at [email protected]. We may still send account, security, legal, or transaction-related notices.

6.3 Request for Data Deletion

If you wish to have your data deleted from our system, please email us at [email protected] and include the email address that you wish to have deleted. Parents and legal guardians may submit deletion requests for minors where permitted or required by applicable law. We will respond to your verifiable request within 45 days of receipt, or notify you if we require additional time as permitted by applicable law.

6.4 California Privacy Rights Under the CCPA/CPRA

6.4.1 Do Not Track Requests

As described in more detail above in Section 4 on “Cookies,” we use cookies to collect information about your internet activity to help us provide you with relevant advertisements. Some web browsers or smartphones have the ability to set “Do Not Track” requests to block user activity from being tracked across web pages or devices. Our Site does not currently recognize “Do Not Track” signals because there is no industry standard way to do so. However, we do recognize and honor Global Privacy Control (“GPC”) signals as a valid opt-out request under California law. If your browser or extension sends a GPC signal, we will treat it as a request to opt out of the sale or sharing of your Personal Information.

6.4.2 Third-Party Advertising

We do not sell your Personal Information for money. We may share Personal Information with third-party advertising partners for cross-context behavioral advertising purposes, which may be considered “sharing” or a “sale” under California and other applicable privacy laws. We do not knowingly sell or share the Personal Information of users under 16, or process minors’ Personal Information for targeted advertising, unless permitted by applicable law and any required consent has been obtained. You have the right to opt out of such sharing by contacting us at [email protected] or by using the opt-out mechanisms described in this Policy.

6.4.3 Your California Privacy Rights

If you are a California resident, you have the following rights under the California Consumer Privacy Act and the California Privacy Rights Act:

Right to Know. You may request that we disclose the categories of Personal Information we have collected about you, the categories of sources from which it was collected, the business or commercial purpose for collecting, selling, or sharing it, the categories of third parties to whom we disclose it, the specific pieces of Personal Information we hold about you, and, if we sold or shared your Personal Information, the categories sold or shared and the categories of third parties who received it.
Right to Delete. You may request deletion of the Personal Information we have collected from you, subject to certain exceptions permitted by law.
Right to Correct. You may request correction of inaccurate Personal Information that we maintain about you.
Right to Data Portability. You may request a copy of your Personal Information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit it to another entity.
Right to Opt Out of Sale or Sharing. You may opt out of the sale or sharing of your Personal Information for cross-context behavioral advertising purposes.
Right to Limit Use of Sensitive Personal Information. You may limit our use and disclosure of your Sensitive Personal Information to purposes reasonably necessary to provide the goods or services you request and other purposes permitted by law, as described in Section 6.7.
Right to Non-Discrimination. We will not discriminate against you for exercising any of these rights. Unless permitted by law, we will not deny you goods or services, charge you different prices, provide you a different level of quality, or suggest that you will receive different prices or a different quality of goods or services because you exercised your rights.

6.4.4 How to Exercise Your California Rights

You may exercise your California rights by using any “Do Not Sell or Share My Personal Information” link or other privacy-choice mechanism we make available, by transmitting a Global Privacy Control signal as described in Section 6.4.1, or by contacting us at [email protected]. Parents and legal guardians may submit requests for minors where permitted or required by applicable law. You may also designate an authorized agent to submit a request on your behalf. We may require proof that the agent is authorized to act for you, such as a power of attorney or signed written permission, and we may require you to verify your own identity directly with us.

6.4.5 Verification of Requests

To protect your privacy, we will verify your identity before responding to a request. You will need to provide enough information for us to reasonably verify that you are the person about whom we collected Personal Information, such as your full name, contact information, account information, and a description of the right you wish to exercise and the information to which your request relates. If a parent or legal guardian submits a request for a minor, we may request information reasonably necessary to verify the requester’s authority and the minor’s identity. We will not require sensitive identity documents unless reasonably necessary to verify the request. We will respond to a verifiable request within 45 days of receipt. If we require additional time, up to 90 days in total, we will notify you of the extension and the reason for it. Any Personal Information we collect in order to verify your identity will be used solely for verification and will be deleted once verification is complete unless retention is required or permitted by law.

6.5 Additional Rights for EEA and UK Residents

If you are located in the European Economic Area or the United Kingdom, you have the following additional rights under the GDPR and the UK GDPR:

Right to Confirmation and Access. You may obtain confirmation of whether we are processing your Personal Information and, if we are, access that information and receive details about the processing, including the purposes, the categories of data, the recipients, the retention periods, and your rights.
Right to Rectification. You may request correction of inaccurate Personal Information and completion of incomplete Personal Information.
Right to Erasure. You may request deletion of your Personal Information where it is no longer necessary for the purposes for which it was collected, where you withdraw consent and there is no other legal ground for processing, where you object to processing based on legitimate interests and there are no overriding legitimate grounds, where the data has been unlawfully processed, or where deletion is required to comply with a legal obligation.
Right to Restriction of Processing. You may request restriction of processing while we verify the accuracy of contested Personal Information, where processing is unlawful but you prefer restriction to erasure, where we no longer need the data but you require it for legal claims, or where you have objected to processing pending verification of overriding grounds.
Right to Data Portability. Where processing is based on consent or performance of a contract and is carried out by automated means, you may receive your Personal Information in a structured, commonly used, and machine readable format and transmit it to another controller without hindrance.
Right to Object. You may object at any time, on grounds relating to your particular situation, to processing based on legitimate interests. We will cease that processing unless we demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or the processing is necessary for legal claims.
Right Not to Be Subject to Solely Automated Decision-Making. You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning you or similarly significantly affects you, unless the decision is necessary for entering into or performing a contract, is authorized by law, or is based on your explicit consent.
Right to Withdraw Consent. Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.
Right to Lodge a Complaint. You may lodge a complaint with a supervisory authority, in particular in the EU member state or UK nation of your habitual residence, place of work, or place of the alleged infringement. We will respond without undue delay and in any event within one month of receipt. We may extend that period by two further months where necessary, taking into account the complexity and number of requests, and we will inform you of any extension.

6.6 Rights for Residents of Other U.S. States

If you are a resident of Virginia, Colorado, Connecticut, Utah, Texas, Montana, Oregon, Delaware, Iowa, or Tennessee, you may have some or all of the following rights under your state’s privacy law: the right to confirm whether we are processing your Personal Information; the right to access it; the right to request its deletion; the right to obtain a copy in a portable and, to the extent technically feasible, readily usable format; the right to correct inaccuracies; and the right to opt out of the sale of your Personal Information, of targeted advertising, and of profiling in furtherance of decisions that produce legal or similarly significant effects. State privacy laws may also require consent to process children’s or minors’ Personal Information as sensitive data, or restrict targeted advertising, sale, or profiling involving minors.

We recognize and honor Global Privacy Control signals as a valid opt-out request for the sale of Personal Information, for sharing or processing for targeted advertising, and for profiling, where required by your state’s privacy law.

6.7 Sensitive Personal Information

Applicable state privacy laws treat certain categories of Personal Information as sensitive and subject to heightened protection. We may collect the following categories of Sensitive Personal Information:

Financial account information, including billing information, limited payment details, payout information, and tax information collected when you purchase access to an Event, sign up for a creator plan, or participate in a sponsor, revenue-share, or similar commercial program. As described in Section 1.3, payment processing is handled by our third-party payment processor and we do not directly store your full payment card number.
Geolocation information, which may include approximate location derived from IP addresses or device information when you access our Platform. We do not use IP address alone to determine your precise geolocation.
Information from social media accounts, including characteristics such as birth date, age, gender, or other profile information, where you have chosen to share that information with us. We do not ask you to provide racial or ethnic origin, religious beliefs, union membership, or similar sensitive characteristics through the Platform.
Contents of communications, including chats, comments, and messages you post during Events, unless we are the intended recipient of the communication.
Information you choose to provide about existing sponsor restrictions, category conflicts, exclusivity commitments, eligibility limits, or similar constraints, which may include sensitive information if you include it in those communications. Please do not provide sensitive information unless it is relevant to evaluating or administering an opportunity or otherwise requested by us.

We use and disclose Sensitive Personal Information only to provide the goods and services you request, including processing payments, managing your account, confirming eligibility or legally required parent or legal guardian consent, delivering Event access, and administering creator, sponsor, revenue-share, payout, tax, or similar commercial programs in which you participate or ask to be considered; to ensure the security and integrity of our Platform and to prevent fraud and illegal activity; for short-term, transient use, including non-personalized advertising shown as part of your current interaction with us; to perform services on our behalf, such as payment processing, analytics, tax administration, and customer support; to verify or maintain the quality and safety of our Platform; and for other purposes permitted under applicable law that do not require your separate consent or an opportunity to limit use.

If you are a California resident, you have the right to limit our use and disclosure of your Sensitive Personal Information to the purposes listed above. 6.8 International Data Transfers

ShowUs, Inc. is based in the United States. If you access our Platform from outside the United States, your Personal Information will be transferred to, stored in, and processed in the United States and potentially in other countries in which we or our service providers operate.

If you are located in the European Economic Area or the United Kingdom, your Personal Information may be transferred to countries that may not provide the same level of data protection as your home country. Where required for such transfers, we use safeguards such as Standard Contractual Clauses approved by the European Commission, the UK International Data Transfer Agreement or Addendum for transfers from the United Kingdom, supplementary technical, organizational, and contractual measures, and reliance on adequacy decisions where they are available. 6.9 Additional California Disclosures

Sale and Sharing. We do not sell your Personal Information in exchange for monetary consideration. We share the following categories of Personal Information with third-party advertising partners for cross-context behavioral advertising purposes, which may constitute sharing under California law: identifiers, including online identifiers and IP addresses; internet and network activity information, including browsing history and interaction with advertisements; and inferences, including preferences and interests derived from your activity. We may also disclose identifiers, commercial information, internet or network activity, profile or content information, analytics, and inferences to sponsors, brand partners, analytics providers, payment processors, service providers, and professional advisors for the business and commercial purposes described in this Policy, including to evaluate, administer, monetize, report on, and support Creator sponsor, revenue-share, and similar commercial programs. We do not knowingly sell or share the Personal Information of users under 16, or process minors’ Personal Information for targeted advertising, unless permitted by applicable law and any required consent has been obtained. We have shared these categories with advertising networks and data analytics providers in the preceding 12 months.

Categories of Sources. We collect Personal Information directly from you, automatically through your use of our Platform, from social media channels when you interact with us or link your accounts, from sponsors, brand partners, agencies, and similar commercial partners where relevant to Creator opportunities or programs, and from third-party service providers such as payment processors and analytics providers.

Categories of Recipients. We disclose Personal Information to service providers, payment processors, analytics providers, affiliates, business partners, sponsors, brand partners, agencies, advertising partners, professional advisors, legal and regulatory authorities, and potential acquirers or successors in connection with a merger, acquisition, or asset sale.

Retention. We retain each category of Personal Information for the periods described in Section 2.2 of this Policy.

6.10 Automated Decision-Making and Profiling

We may use automated processing of your Personal Information to evaluate, analyze, or predict your preferences for content, Events, Platform features, or sponsor and brand opportunities that may interest you or for which you may be eligible. This is referred to as profiling. We may engage in profiling to recommend Events or content tailored to your interests, personalize your Platform experience, evaluate potential Creator sponsor or commercial opportunities, and analyze user engagement, campaign performance, and Platform usage patterns. These activities may be based on your account information, Event participation history, browsing behavior, interactions with Platform features, Creator profile or content information, sponsor preferences or conflicts that you provide, performance analytics, and inferred preferences.

We do not engage in solely automated decision-making, meaning decision-making without human involvement, that produces legal effects concerning you or similarly significantly affects you, except where the decision is necessary for entering into or performing a contract with you, is authorized by applicable law, or is based on your explicit consent.

Depending on where you are located, you may have the right to object to profiling and to request human review of automated decisions, or to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities;
Cooperate with law enforcement agencies concerning conduct or activity that the business, service provider, or third-party reasonably and in good faith believes may violate federal, state, or local law;
Exercise or defend legal claims;
Detect security incidents and protect against fraudulent or illegal activity and prosecute those responsible for such activity;
Transfer Personal Information as part of a merger or acquisition, dissolution of ShowUs, Inc., or in the event of bankruptcy or any other transaction in which a third party assumes control of all or part of ShowUs, Inc.
